A brief insight into article 370; it's history and how it originated



Article 370 is a permanent feature of our constitution which is very difficult to remove. This is due to the reason when article 370 was formed by Sheikh Abdullah in 1950 it was passed by the constituent assembly of the state of Jammu and Kashmir. The proposals mentioned in the article 370 was adopted by the Indian constitution and the constitution of Jammu and Kashmir also accept it. The Jammu and Kashmir has a special status in India and that is why it has its own constitution and it is much autonomous then rest of Indian state.  Their was one clause in the article 370 that it is formed by the Jammu and Kashmir constituent assembly and can be removed by the constituent assembly of Jammu and Kashmir. After the formation of article 370 the constituent assembly dissolve itself and thus the only way the article 370 can be removed is gone.
The article 370 is a temporary provision but ironically it is now a permanent feature as the reason stated above. Due to article 370 their are more problems than merits. Their is a serious lack of jobs because there are virtually no private companies and those who exist in there are have very meager operations because they cannot open full fledged office here. No one can take land here in jammu and Kashmir so all the office of private companies is owned by the person of Jammu and Kashmir. Their are infrastructure wise less development as no one wants to come to Jammu and Kashmir due to a misconception which I have cleared in this article Misconception of Jammu and Kashmir and the fact is even though someone wants to invest in jammJ and Kashmir he can't because of this article 370. So in all the article 370 should be removed but the real question is how because legally it can't.
